1. Who operates MyTosi

MyTosi (the "Service") is owned and operated by Nooded Technologies LLC, a Connecticut limited liability company (“Nooded Technologies,” “we,” “us”). These Terms of Use and Disclaimer (the “Terms”) govern use of MyTosi by any member, or by anyone who sets up or manages a member's account on their behalf (“you”).

2. Acceptance of these terms

By checking the acceptance box when adding a member, by using MyTosi on a call, or by allowing MyTosi to be added to a call on your behalf, you agree to these Terms. If you do not agree, do not use the Service. If you are accepting on behalf of another person (for example, a parent setting this up for a senior family member), you represent that you have the authority to do so and that the person has agreed, or that you are their legal guardian or have other lawful authority to consent on their behalf.

3. What MyTosi is

MyTosi is an automated phone assistant that listens for common signs of phone scams and offers guidance in plain language. It is a helper, not a guarantee. It does not replace your own judgment, the advice of your bank, law enforcement, or a trusted family member.

4. No guarantee; assumption of risk

MyTosi may fail to detect a real scam, or may flag a legitimate call as suspicious. Automated scam detection is not perfect. You understand and accept that MyTosi is a supplementary tool only, and you voluntarily assume all risk associated with relying on it. You remain solely responsible for your own decisions during any call, including whether to share information, send money, or hang up. Nooded Technologies is not responsible for the independent criminal acts of third parties, including any scammer or fraudster on a call.

5. Call monitoring & recording consent

When MyTosi is added to a call, it announces itself and states that the call is being checked for the member's protection. By adding MyTosi to a call, or by setting up a member's account on their behalf, you confirm you have the authority and consent needed under applicable law (including any state two-party/all-party consent requirements) for MyTosi to listen to and process that call, and you agree to indemnify Nooded Technologies for any claim arising from a lack of such consent or authority.

6. Family text alerts

If enabled for a member, MyTosi may send text messages to a family contact when a call appears risky. By providing a family contact's phone number and enabling this feature, you confirm that contact has agreed to receive these messages.

7. Eligibility

The person accepting these Terms on a member's behalf must be at least 18 years old and legally able to enter into this agreement, or be a parent or legal guardian consenting on behalf of a minor or dependent family member.

8. Disclaimer of warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING WITHOUT LIMITATION WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, OR NON-INFRINGEMENT. NOODED TECHNOLOGIES DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT IT WILL CORRECTLY IDENTIFY EVERY SCAM OR AVOID EVERY FALSE ALARM.

9. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, NOODED TECHNOLOGIES, ITS OWNERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF MONEY, DATA, OR GOODWILL, ARISING FROM OR RELATED TO USE OF THE SERVICE, INCLUDING LOSSES RESULTING FROM AN UNDETECTED SCAM, A FALSE ALARM, OR SERVICE UNAVAILABILITY, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. TO THE EXTENT ANY LIABILITY IS NOT EXCLUDABLE, NOODED TECHNOLOGIES' TOTAL AGGREGATE LIABILITY WILL NOT EXCEED THE GREATER OF $100 OR THE TOTAL AMOUNT YOU PAID NOODED TECHNOLOGIES FOR THE SERVICE IN THE 12 MONTHS BEFORE THE CLAIM AROSE (WHICH FOR A FREE PILOT USER IS $0).

10. Indemnification

You agree to indemnify and hold harmless Nooded Technologies from any claim, loss, or expense (including reasonable attorneys' fees) arising from your use or misuse of the Service, your violation of these Terms, or your violation of any law or the rights of a third party.

11. Not professional advice

MyTosi does not provide legal, financial, medical, or law-enforcement advice. For suspected fraud, contact your bank, local police, or the Federal Trade Commission directly.

12. Suspension and termination

Nooded Technologies may suspend or terminate access to the Service for any member at any time, including for suspected abuse, excessive use, or any reason, with or without notice.

13. Changes to these terms

Nooded Technologies may update these Terms from time to time. Continued use of the Service after a change takes effect constitutes acceptance of the updated Terms. Material changes will be reflected by a new version date at the top of this page.

14. Dispute resolution; governing law

These Terms are governed by the laws of the State of Connecticut, without regard to conflict-of-law principles. Any dispute arising from these Terms or the Service will first be attempted to be resolved informally by contacting Nooded Technologies directly.

15. Severability; entire agreement

If any provision of these Terms is found unenforceable, the remaining provisions remain in full effect. These Terms are the entire agreement between you and Nooded Technologies regarding the Service and supersede any prior agreements.
